Nope, if the patron has chosen to do business in a stupid shitty country like mine they should pay a reasonable tip or they’re an asshole. I agree that it’s a completely stupid system that needs change, but screwing the server for a stupid culture they have no control over is not cool.
Just because they should, doesn’t mean they must. There is a legal obligation to pay the bill, but there is no legal obligation to tip the server.
I’d argue that in NA, the tip is expected and basically the default, and you have to do something wrong to lose that tip. Racism and/or legal status of the server is not a valid reason, though.
Oh yeah, I didn’t say they’d be arrested, I said they’d be an asshole. Not only are there tons of perfectly legal ways to be an asshole in America, it’s usually a very effective way of personally enriching oneself.
The patron only has a responsibility to pay for thier meal, not subsidize the wages of the servers. Places outside of the US have figured that out.
Not tipping isn’t withholding pay or payment.
Edit: tipping culture is a failure of worker protections.

It’s pay in the US. Your country’s customs are not universal.
